Statement of Attorney General Anne Milgram on New Jersey Supreme Court Decision in State v. Chun
March 17, 2008 -- “We are pleased with the Court’s decision upholding the scientific reliability of the Alcotest and the admissibility of its results in evidence. The Court’s ruling provides a firm foundation for using this next generation of breath testing instrument in the enforcement of our drunken driving laws.
The Alcotest, utilizing state-of-the-art technology and a host of additional safeguards, will provide strong evidence and sure justice for those who violate New Jersey’s drunken driving laws. It will be an invaluable tool for police in their efforts to protect the lives of all motorists who use New Jersey’s roadways.”
“I want to commend the attorneys who represented the State, including Assistant Attorney General Boris Moczula, Deputy Attorney General Christine Hoffman, Deputy Attorney General John Dell’Aquilo, Deputy Attorney General Robert Lougy, retired Deputy Attorney General Stephen H. Monson, and retired Assistant Attorney General Jessica S. Oppenheim. I also want to thank the members of the New Jersey State Police who assisted them, particularly Sgt. Kevin M. Flanagan.
