Illinois Supreme Court Rejects Emerald Casino's Attempt to Overturn Revocation of Its License

November 29, 2007 -- Chicago – The Illinois Supreme Court today sustained the Illinois Gaming Board's (IGB) December 2005 order revoking Emerald Casino's license to operate a casino in Rosemont. On May 30, 2007, in a 152-page ruling, the Illinois Appellate Court, Fourth District, in Springfield , affirmed the Gaming Board's revocation order. Today, the Illinois Supreme Court denied Emerald's request to review the Appellate Court's decision. The Supreme Court's action makes the revocation order final, unless it grants a petition for reconsideration.

“This is the second major decision this week by the courts upholding our efforts to ensure integrity in the Illinois gambling industry, which is critical to public confidence in the operation of casinos in Illinois ,” said Illinois Attorney General Madigan. “This decision sends a clear signal that this license is, in fact, revoked and moves the State a significant step closer to being able to reissue the license to suitable owners and generate much-needed revenues for the benefit of the people of Illinois .”

On Monday, the Illinois Appellate Court, First District in Chicago ruled that its June 2006 decision requiring the IGB to renew Emerald's license for four years did not nullify the IGB's order revoking that license. In both cases, the courts have concluded that the license remains revoked.
