Indiana Attorney General Alleges Consumer Fraud against Defunct Allen County Car Dealer

September 25, 2007 -- INDIANAPOLIS, IN – Indiana Attorney General Steve Carter has filed a lawsuit in Allen County Circuit Court against Select Automotive for accepting full payment for vehicles then failing to deliver the titles to seven customers. Carter is seeking a court order that would give the customers the titles along with costs and civil penalties.

“This dealership took people for a ride, accepting payment for vehicles and then not giving them the required proof of their purchase,” Attorney General Steve Carter said.

Since at least December 2005, Select Automotive sold used vehicles at 4707 State Road 101, Woodburn, Indiana. Seven customers paid a total of more than $130,000 for their vehicles and never received their titles. Carter alleges Select Auto knew, or should have known, that they could not deliver the titles.

This formal court action is necessary to secure the permanent titles from the Indiana Bureau of Motor Vehicles.

Carter is also seeking an injunction prohibiting similar action in the future along with cancellation of the consumers’ contracts, costs and civil penalties.
