California Governor Schwarzenegger Issues Statement on Lethal Injection Protocol
05/15/2007 -- In response to deficiencies in California’s lethal injection protocol identified by Federal Judge Jeremy Fogel in December 2006, California Governor Arnold Schwarzenegger issued the statement below. The Department of Corrections and Rehabilitation today submitted a report and revised protocol to address the deficiencies in the lethal injection process to ensure that the protocol and its implementation is constitutional.
“Today, my administration submitted a comprehensive plan that addresses the court's concerns and will maintain the death penalty in California. I am committed to doing whatever it takes to ensure that the lethal injection process is constitutional so the will of the people is upheld. My staff has worked in conjunction with the Department of Corrections and Rehabilitation and the Department of Justice to review and modify the lethal injection process. I am confident that the plan submitted to Judge Fogel will address his concerns and allow the State to enforce the law of the land.”
